Acceptable Use Policy

Rules governing lawful and legitimate use of our service

This Acceptable Use Policy (“AUP”) governs your use of the Noimosiny platform, website, and API (collectively, the “Service”) and is incorporated by reference into our Terms of Service. By using the Service, you agree to comply with this AUP. Violation of this AUP is a material breach of the Terms of Service.

1. Purpose

Noimosiny provides open-source intelligence tooling intended for lawful, legitimate professional and personal-safety purposes, including but not limited to: fraud prevention and investigation, due diligence, journalism and public-interest research, cybersecurity and threat intelligence, brand protection, preliminary vendor/business due diligence (e.g., confirming a company’s public digital footprint or professional presence — not a hiring or employment eligibility decision, see Section 3.2), and an individual’s review of their own digital footprint.

This AUP exists to make sure the Service is not turned into a tool for surveillance, harassment, or abuse of the very individuals whose public data it indexes.

2. Eligibility and Attestation

By using the Service you affirm that:

  • You are at least 18 years old;
  • You have a lawful basis and legitimate purpose for each search you perform;
  • You will only investigate individuals or entities you are legally authorized to investigate, or information about yourself;
  • You will comply with all applicable laws in your jurisdiction and the jurisdiction of the data subject, including privacy, anti-stalking, anti-harassment, computer-crime, and data-protection laws (e.g., GDPR, CCPA/CPRA, and equivalent state and foreign frameworks).

Because access is based on your attestation rather than independent verification, Noimosiny relies on strict enforcement of this AUP: violations, or credible reports of violations, result in immediate account suspension pending investigation, and may be reported to law enforcement.

3. Prohibited Uses

You must not use the Service, or any data obtained through it, to:

3.1 Harm to individuals

  • Stalk, harass, threaten, intimidate, or abuse any person;
  • Dox, or facilitate the doxxing of, any individual (i.e., publicly disclosing private or identifying information with intent to harm, expose, or intimidate);
  • Locate a person for the purpose of causing physical, emotional, financial, or reputational harm;
  • Facilitate domestic violence, human trafficking, or any form of exploitation;
  • Target, identify, or attempt to identify victims or survivors of crime, abuse, or harassment against their wishes;
  • Identify or attempt to identify anonymous or pseudonymous individuals (e.g., whistleblowers, journalists’ sources, content creators, activists) for the purpose of retaliation, suppression, or exposure.

3.2 Unlawful or regulated decision-making

  • Determine eligibility for credit, insurance, employment (including recruitment, hiring, promotion, or termination decisions), housing/tenancy, or any other purpose that would cause the output to constitute a “consumer report” under the FCRA or equivalent law, unless you are independently licensed and compliant to do so and such use is expressly permitted by Noimosiny in writing;
  • Make decisions about an individual that produce legal or similarly significant effects on them based solely on Service output without independent verification.

Note: Section 1 permits preliminary vendor/business due-diligence research (e.g., confirming a company’s public presence). It does not permit using Service output as a factor in an actual employment or hiring decision about a specific individual — that use is prohibited by this Section 3.2 regardless of how the search was initially framed.

3.3 Circumvention and technical abuse

  • Attempt to access private, password-protected, or otherwise access-restricted accounts or data;
  • Use hacking, credential stuffing, social engineering, or unauthorized intrusion in connection with the Service;
  • Reverse-engineer, scrape (beyond documented API use), or interfere with the Service’s infrastructure, rate limits, or security controls;
  • Share, resell, sublicense, or provide unauthorized third-party access to your account, API key, or Service output as a data feed or competing product, without our prior written consent.

3.4 Illegal activity generally

  • Any use that violates local, state, federal, or international law, including export-control and sanctions laws;
  • Use in furtherance of fraud, identity theft, extortion, blackmail, or any criminal enterprise;
  • Use by, or on behalf of, any person or entity on a U.S. or international sanctions or denied-party list, or located in a comprehensively sanctioned jurisdiction.

3.5 Minors

  • Any use targeting a minor for purposes other than a minor’s own parent/legal guardian exercising a lawful safety interest in compliance with applicable law.

4. Data Handling Obligations

If your use case involves storing, exporting, or further distributing information obtained through the Service, you are independently responsible for:

  • Complying with applicable data-protection law with respect to that downstream processing (you act as an independent controller for your own use of exported data);
  • Implementing reasonable safeguards against unauthorized access to exported data;
  • Honoring any deletion or access requests you receive from data subjects to the extent required by law;
  • Not further disclosing information in a manner that would violate Section 3 of this AUP.

5. Reporting Misuse

If you believe the Service is being used to stalk, harass, or endanger you or someone else, contact us immediately at [email protected]. We investigate credible reports of misuse and may suspend accounts pending investigation. Where we have a good-faith belief that a User’s conduct poses a risk of harm, we may report the matter to law enforcement and, where legally required, to the data subject.

6. Enforcement

6.1. Noimosiny may investigate suspected violations of this AUP and take action including warnings, feature restriction, suspension, or termination of an account, without refund, at our sole discretion.

6.2. We may retain relevant account and query records following a suspected violation for as long as reasonably necessary for investigation, legal compliance, or cooperation with law enforcement, consistent with our Privacy Policy.

6.3. Noimosiny reserves the right to deny service to any prospective User whose stated or apparent purpose is inconsistent with this AUP, without obligation to explain the basis for that decision, except where required by law.

7. Changes to This Policy

We may update this AUP from time to time. Material changes will be posted with an updated “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.
