Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“User,” “you,” “Client”) and NOIMOSINY LLC, a Wyoming limited liability company with a mailing address at 30 N Gould St #59074, Sheridan, WY 82801, doing business as Noimosiny (“Noimosiny,” “we,” “us,” “our”), governing your access to and use of the website located at noimosiny.com, the API at api.noimosiny.com, and all related services and features (collectively, the “Service”).

By creating an account, purchasing credits, or otherwise accessing the Service, you agree to these Terms, our Acceptable Use Policy (incorporated here by reference), and our Privacy Policy. If you do not agree, do not access or use the Service.

1. Eligibility

1.1. You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service.

1.2. By registering, you represent and warrant that:

• You are 18 years of age or older;
• All registration information you provide is accurate, current, and complete;
• You will maintain the accuracy of such information;
• You have a lawful, professional, or otherwise legitimate purpose for using the Service, consistent with our Acceptable Use Policy;
• You are not located in, or a national or resident of, any country or region subject to U.S. trade sanctions or embargoes, and you are not on any restricted-party or denied-persons list maintained by the U.S. government or other applicable authority.

1.3. Noimosiny reserves the right, at its sole discretion, to accept or decline any application for an account, and to suspend or terminate any account, based on the information available to us, including where we reasonably suspect a violation of these Terms or the Acceptable Use Policy.

1.4. If you are using the Service on behalf of a company, agency, or other organization, you represent that you have authority to bind that entity to these Terms, and “you” refers to both you individually and that entity.

2. Description of the Service

2.1. Noimosiny is a software-as-a-service open-source intelligence (“OSINT”) platform that aggregates and cross-references publicly available information across a range of third-party sources (including, without limitation, social media platforms, e-commerce marketplaces, fitness and lifestyle applications, and other online services) in response to identifiers submitted by a User, such as email addresses, phone numbers, and usernames.

2.2. The Service operates by querying third-party APIs, publicly accessible endpoints, and other open-source data. Noimosiny does not access private, password-protected, or otherwise restricted accounts, and does not employ hacking, unauthorized intrusion, or circumvention of any access control to obtain data.

2.3. Noimosiny is not a consumer reporting agency as defined by the U.S. Fair Credit Reporting Act (“FCRA”), and the Service is not a “consumer report” as defined by the FCRA. Noimosiny does not verify, and cannot guarantee, the accuracy, completeness, or currency of any information returned by the Service. See Section 8 (Prohibited Uses tied to Regulated Purposes) and our Acceptable Use Policy.

2.4. Credits, subscription tiers, and source/API access are subject to the specific plan you purchase, as described at noimosiny.com/pricing, which is incorporated into these Terms by reference and may be updated from time to time. History/Investigation Archive retention is not plan-dependent — regardless of your plan, you control retention of your own search history and any linked images as described in our Privacy Policy (delete individual entries, delete your full history, disable logging going forward, or close your account).

3. Account, Credits, and Billing

3.1. Account security. You are responsible for maintaining the confidentiality of your login credentials and API keys, and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized use.

3.2. Credits and subscriptions. Access to data sources and searches is provided on a credit or subscription basis as described on our Pricing page. Purchased credits are non-transferable and do not expire.

3.3. Payment processing. Card payments are processed by Stripe, and cryptocurrency payments are processed by Cryptomus, our third-party payment processors, and we may in the future also engage other providers. By making a purchase, you agree to the applicable processor’s terms. Noimosiny does not store full payment card numbers.

3.4. Refunds. Except where required by applicable law, purchased credits, subscription fees, and unused balances are non-refundable. Noimosiny may, at its sole discretion, issue refunds or credits in cases of service error or billing mistake.

3.5. Price changes. We may change our pricing prospectively with notice posted on the Service; changes will not affect credits already purchased.

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which prohibits, among other things, use of the Service to stalk, harass, dox, intimidate, or unlawfully surveil any individual. Violation of the Acceptable Use Policy is a material breach of these Terms and may result in immediate suspension or termination of your account without refund, and may be reported to law enforcement where Noimosiny reasonably believes unlawful activity has occurred or may occur.

5. Intellectual Property

5.1. The Service, including its software, design, interface, source-integration architecture, and branding (excluding third-party data returned in search results), is the property of Noimosiny and its licensors and is protected by U.S. and international intellectual property laws.

5.2. Subject to your compliance with these Terms, Noimosiny grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose during your subscription term.

5.3. You must not: (a) reverse-engineer, decompile, or disassemble any part of the Service; (b) access the Service through any means other than the interfaces and APIs we provide; (c) resell, sublicense, or provide third-party access to the Service or API without our prior written consent; (d) use automated means (scraping, bots) to access the Service beyond documented API usage; or (e) remove or obscure any proprietary notices.

5.4. Data returned through the Service originates from third-party sources. Noimosiny does not claim ownership over such third-party data and makes no representation regarding your rights to use it beyond what is permitted under applicable law and these Terms.

6. Third-Party Sources and Availability

6.1. The Service relies on data and APIs provided by third parties (including, without limitation, social media platforms and other online services) that are outside Noimosiny’s control. We do not guarantee the availability, accuracy, completeness, or continued existence of any third-party source, and we are not liable for disruptions, inaccuracies, or discontinuations resulting from changes made by third parties.

6.2. Data sources may be added, modified, or removed at any time without notice.

7. Disclaimers

7.1. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7.2. NOIMOSINY DOES NOT WARRANT THAT RESULTS RETURNED BY THE SERVICE ARE ACCURATE, COMPLETE, OR CURRENT. THE SERVICE IS A RESEARCH AID, NOT A SUBSTITUTE FOR PROFESSIONAL VERIFICATION, LEGAL ADVICE, OR INDEPENDENT INVESTIGATION. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY INFORMATION BEFORE RELYING ON IT FOR ANY PURPOSE.

7.3. Noimosiny does not warrant uninterrupted or error-free operation of the Service.

8. Prohibited Uses Tied to Regulated Purposes

You may not use the Service, or any information obtained through it, as a factor in determining eligibility for:

• Credit or insurance underwriting;
• Employment (including hiring, promotion, or termination decisions);
• Housing or tenancy decisions;
• Any other purpose that would render the information a “consumer report” under the FCRA or an equivalent state or foreign law.

The Service is not designed or certified for these purposes, and using it as such is a material violation of these Terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOIMOSINY, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOIMOSINY’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO NOIMOSINY IN THE six (6) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Noimosiny and its officers, members, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service in violation of these Terms, the Acceptable Use Policy, or applicable law; (b) your violation of any third party’s rights, including privacy or intellectual property rights; or (c) any content or instructions you submit to the Service.

11. Suspension and Termination

11.1. Noimosiny may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or applicable law, or if your use poses a risk to Noimosiny, other Users, or any third party.

11.2. We may retain account records and search/query logs following termination as required by law or for legitimate compliance, fraud-prevention, or law-enforcement cooperation purposes, as described in our Privacy Policy.

11.3. Sections 5, 7, 8, 9, 10, and 13 survive termination.

12. Changes to the Service and These Terms

We may modify these Terms at any time. Material changes will be posted on the Service with an updated “Last updated” date, and, where required by law, notified to you directly. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

13.1. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles.

13.2. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.

14. Miscellaneous

14.1. Entire agreement. These Terms, the Acceptable Use Policy, and the Privacy Policy constitute the entire agreement between you and Noimosiny regarding the Service.

14.2. Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.

14.3. No waiver. Failure to enforce any provision is not a waiver of that provision.

14.4. Assignment. You may not assign these Terms without our written consent. Noimosiny may assign these Terms in connection with a merger, acquisition, or sale of assets.
